the happy birthday song

I noticed while I was on youtube playing Grady Martin's "Heartless woman" that he apparently wrote and his group the slew foot five recorded this song which I first heard on a jukebox in Alaska in the late 60's. Is this the reason that for a long time at restaurants and the like, when they sang a birthday celebration they couldn't use Martin's familiar tune and lyrics that we would usually use at home so they would use alternatives songs. I think it's because Grady Martin had the rights to "the happy birthday song" probably for decades.
